Who these terms cover

These terms describe use of the BNAX Designs website and our general service process. “BNAX,” “we,” and “our” refer to BNAX Designs. “You” refers to the visitor or prospective client. Contact us at contact@bnaxdesigns.com with questions about these terms or to request business identification details before entering an agreement.

Our services include brand and website design, web applications and digital tools, business systems and practical AI, project planning, training, and separately scoped support. This website introduces those services; it is not an online checkout. A person entering a project agreement must have legal capacity to contract and authority to act for the named client.

Inquiries, proposals, and agreements

Submitting an inquiry or questionnaire asks us to discuss your project. It does not reserve a start date, accept a proposal, authorize charges, or create a paid engagement. A saved-reference message confirms receipt in our system. It does not confirm email delivery or project acceptance.

Paid work begins under a written agreement accepted by both parties, with any stated commencement conditions satisfied. That agreement should identify the contracting parties, scope, deliverables, exclusions, price, payment schedule, timing, ownership, and acceptance process. A proposal labeled “approved” means BNAX has approved its client copy; it is not evidence of your acceptance or electronic signature.

A signed or otherwise mutually accepted project agreement controls project-specific matters. These website policies do not replace it or amend an existing contract. Mandatory legal protections apply regardless of wording in a policy or agreement.

Information, estimates, and results

Service descriptions, examples, indicative schedules, and displayed starting prices help you assess fit. Your written proposal confirms the actual offer and any expiration date. Budget answers are planning information, not an approved price. We will address a material quotation error before you accept revised terms.

Portfolio examples describe particular work and may include prototypes, founder initiatives, or externally hosted previews. They do not guarantee your results. We do not promise a particular sales level, search ranking, funding outcome, uninterrupted third-party service, or universal suitability of a prototype for production.

General website content and training do not substitute for legal, financial, medical, or other regulated professional advice. Obtain appropriate professional review when your use requires it.

Your information and materials

Provide accurate contact and project information, and share only materials you have authority to provide. Do not submit passwords, payment-card details, government identifiers, medical or student records, or other sensitive information through public forms. Describe a sensitive requirement in general terms so we can discuss a suitable arrangement.

You retain your rights in materials you provide. Providing them for an inquiry permits us to review them and respond about that inquiry; it does not grant ownership or public portfolio permission. The Privacy Policy explains personal-information handling. An inquiry is not a signed nondisclosure agreement; arrange confidentiality requirements before sharing trade secrets.

Website content and project intellectual property

BNAX branding, original website text, and original design materials belong to BNAX or their respective rights holders. You may read, link to, and retain reasonable copies of these policies for reference. Other reuse requires permission or another lawful basis. Third-party names and portfolio materials remain subject to their owners’ rights.

Ownership and licensing of commissioned deliverables, source files, reusable tools, fonts, stock assets, software, and AI-assisted material must be specified in the project agreement. Do not assume every component can be exclusively owned or transferred. Any agreed transfer conditions, including payment conditions, belong in that agreement.

For a rights complaint, email the page address, the work involved, your relationship to the rights holder, supporting details, and a contact method. Please avoid unnecessary personal information. We will review the report and may request clarification. This contact process does not claim registered DMCA-agent status.

Acceptable use and access

Use the site lawfully and follow the Acceptable Use Policy. Do not interfere with forms, impersonate another person, bypass access controls, or access records without permission. Restricted BNAX management areas are for authorized personnel.

We may restrict abusive or unauthorized website activity to protect users and the service, subject to applicable law. A restriction does not erase accrued contractual obligations or rights. Project suspension or termination is handled under the applicable written agreement.

Availability and third-party services

Hosting, networks, browsers, email services, and linked websites can experience outages or changes. We cannot promise continuous availability or that every message reaches an inbox. Use the contact email if a form fails, and retain your saved inquiry reference.

Linked websites and third-party tools have their own terms and privacy practices. A link does not make BNAX responsible for operating that service. Client subscriptions, hosting, and support responsibilities must be identified in the project scope.

Responsibility, disputes, and legal rights

Website information is provided for general information, without a promise that it is error-free or suitable for every purpose. This statement does not reduce any express obligation in an accepted project agreement or any warranty, remedy, or liability that cannot lawfully be excluded.

These website terms do not impose a monetary liability cap, mandatory arbitration, class-action waiver, or a shortened legal claim period. Any negotiated allocation of project risk must be stated clearly in the project agreement and comply with applicable law.

If a concern arises, email contact@bnaxdesigns.com with the relevant reference and requested resolution. We will review the issue and seek a practical resolution. Contacting us is not a prerequisite to exercising rights that the law gives you. Applicable law and jurisdiction are determined by law and any valid project-specific agreement; this page does not select an exclusive court.

Changes and interpretation

We may update these website terms as the site or services change and will display the revision date. Changes do not retroactively change an accepted project agreement. If a particular provision cannot be enforced, the remaining provisions apply to the extent permitted by law. A delay in exercising a right does not by itself waive it.

The Privacy Policy, Cookies & Technology Notice, and other pages in the policy hub explain related practices. Where a summary differs from detailed policy language, read the detailed language together with your accepted agreement and applicable law.
